Will 6 Traffic Offences Affect ILR?

Post by cpvrs » Mon Aug 05, 2013 10:04 pm

Hi,

I currently hold an Tier 2 ICT (Point Based System) Visa valid till Dec 2014.

I am eligible for ILR now.

I have the following Traffic Offences.
1. Parking Ticket - 29 / Nov / 2008 - Fined £35
2. CU 80 (Using mobile while driving) - Fined £60 and 3 Penalty points
3. Driving on a Bus Lane - July / 2011 - Fined £35
4. Speeding SP 30 - 26 / July / 2011 - Fined £250 and 4 Penalty points (This was in Scotland, Summoned by Court and Written "Pleading Guilty" letter )
5. Performing a Prohibited Turn - 30 / Aug / 2011 - Fined £65
6. Entered and Stopped in Box Junction - 14 / Apr / 2013 - Fined £65

Can you please advice me on applying for ILR on this circumstance?

Regards,
CP

You need to drive more carefully. Is the only conviction at court the 2011 one?

Well a non custodial sentence is a general grounds for refusal for 24 months so once that time has lapsed you'll be ok on that point. However, there is always the possibility they coud see you as a persistent offender, showing a disregard for the law, though you only have one conviction. I suggest you avoid any more traffic offences.

Thanks Amber for your response.

Do I need to mention all these 6 offences in the SET(O) application?

Because in the Section 7 of the SET(O) it has been mentioned as below.

<<<Note: We will carry out criminal record checks on all applicants and dependants. You must
give details of all unspent and spent criminal convictions. This includes road traffic offences
but not fixed penalty notices (such as speeding or parking tickets) unless they were part of a
sentence of the court. This includes all drink-driving offences.>>>
