permanent residence

Hi everybody

Under Regulation 12 – Five years of residence with EU citizen you will be entitle for a permanent residence

I have 6 years of residence with EU Citizen but my EUFAM 4 will expire in 06/2014.
My question is :
Can i apply now for a permanent residence or i have to wait my EUFAM4 Expire?

i forgot to mention a detail on my previous post. I'm separated with my wife for the moment, is that will affect my right for the permanent residence?

You can apply for a permanent residence or citizenship after 5 years of residence in Ireland. You dont have to wait for your EUFAM4 to expire.

It never says you must still be married after 5 years to apply for a permanent residence so I think you could apply even if you're separated or divorced.

Note: You have to meet certain residency requirments to apply for citizenship.

You should apply using the form EU5 and not EU3.

May I ask why you havent applied for citizenship yet?

I haven't applied for citizenship because i have only 4 years of legal residence. Please, can you confirm that that i need 5 years of legal residence or i can count the years where i wasn't legal?

Time of illegal residence is not included as a 5 year residency needed for citizenship application.

To apply for citizenship you'll need 5 years of legal residence whilst having a continous 1 year residence prior to the date of your application.

I explain.I have 6 years since i get married in Ireland
1.5: without legal residence
4.5: EUFAM 4

So to apply for citizenship, should i count the 1.5 without legal residence?

No you need more 0.5 residence. Understand?

You need to apply using for EU3 for a permanent residence for Non EEA citizen who have spent 5 years in state as family member of an EU citizen.
EU5 is for an EU1 Residence Card holder seeking to retain permission after divorce/annulment or the death or departure of the EU citizen.
You are still a family member of an EU citizen.
