special circumstance (financial) spouse visa

hi All, i am new here. please answer my query. i am pakistani citizen and living here. my wife is british and my 8month old daughter is also .my daughter is effected a severe decease and also need surgery near future. my wife and daughter is living there with uncle (mother's brother). my baby need special care dosing thrice in a day.my wife is jobless we have 34000 pound in our account since last month. we sold our property . am i able to apply for spouse visa. i meet all requirements of spouse visa english test, british wife, marriage certificates , pics etc. please answer me

Your wife should consider applying for Disability Living Allowance for the child at once (unless this has already been done?), if successful then you will be exempt from the financial requirement. At the moment your savings is not enough and your application will not succeed it will be placed on hold for an unknown period.

Really thanks for fast reply, please let me know if Disability Living Allowance for the child my wife applied today and her application will success . am i able to apply for v next day. and am i exempt from financial requirements.

Once you have the DLA award notice and at least one payment has been made in the bank for which you have a statement, you can apply.

DLA is available to children under 16 who have care and or mobility needs above that of a 'healthy' child of the same age. Mobility component is not available for very young children but the care component is, you have one month to appeal a decision. See https://www.gov.uk/disability-living-al ... n/overview

one more question infact requestion . please tell me if my daughter got DLA . after one month if i apply for a visa . am i exempt for funds maintenance .?
and which visa should i apply ? spouse visa ?
i know this my queries are childish . i m sorry.

You are exempt from the new financial requirement if your child is receiving DLA. Thus, you would have to adequately maintain and accommodate yourselves. If you are relying on savings alone, I would expect, £112.55 + £65.62 x 130 weeks = £23161.10 to suffice, which you have. Though, you must remember your wife will be claiming child benefit and tax credits which can be used as income, so it's likely around £14500 in savings would suffice for adequate maintenance.

I've given my answer, if you only do not meet the financial requirement, your application will be stayed/paused. I've said applying for DLA is perhaps the best option as your sponsor isn't working and you're in Pakistan and your savings fall short.
