Questions:
- Can he apply Tier1 dependent in the UK? (i.e. switch from PSW to Tier1 dependent)

I think No, unfortunately needs to seek EC from India

- Can he apply ILR along with her in Feb2014? (as 5 year rule started in July2012, but 2 year still applies for people already in the UK?)

That is also no as new EC will cater as per post 9th July 2012 immigration rules (5 years probationary period).

1. For Point(1), I was also of the same opinion. Thanks for the link.
2. For Point(2), I got your point. In this case, can he get Entry Clearance (Tier1 dependent) from India, in Feb2014 get FLR and in Feb2015, can he go directly to citizenship if wife becomes a BC?
Will getting EC from India break his continous stay in the UK for being partner of a BC?
