Query on ILR application

Hi Friends,

I have a below query regarding PR, can anyone please help me.

I got my Tier-I visa for 3years which is valid from 1st FEB 2009. I came into UK on 26th July 2009, means 176 days out of UK. I got the extension in FEB 2012 for another 2years.

My current visa will expire by 1st FEB 2014. By that time I'll be completing more than 4.5 yrs in UK.

My doubt is do I need to go for another Extension to get eligibility for PR or can I go for PR by following the below rule stated in "Indefinite leave to remain – calculating continuous period
in UK" doc (http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary)

No more than 180 whole days absence are allowed in any of the five, two, three or four
consecutive 12 month periods, depending on the category, preceding the date of the
application for indefinite leave to remain (ILR).

You will have to go for another extension and then apply for your ILR in July 2014 as your clock starts from the day you entered in this country and not the day you were given entry clearance visa.
and yes count your out of the country days retrospectively from the day when you going to apply for ILR i,e from July 2014 to July 2013 and so on.
