Help please:apply spouse visa, inside or outside uk?

I had a 5 year work permit visa since 12/08, due to recession,the company closed down
suddenly on 01/09, I could not find another company to transfer my work permit. on 02/09 I joined a new company and worked there for two years, paid tax , and in between
I went abroad many times for holidays ,when entry the custom, I just filled in the old company details.Basically I worked another company but with old work permit, and the home office does not know my old company closed down, since they did not cancel my visa yet.

now this year June I got married ,my husband is permanent here, I got all the documents
to apply spouse visa, and I will use six month savings for financial requirements.

But since my work permit is actually invaild, so have I already breached the rules? So
if I applied inside uk ,will I get refused definitely? And I will not have right to appeal?
Or if they gave me right to appeal, but I have to apply for DLR, which can take 10 years?

Or if I go back my home country will the case worker would not brother my past five years in uk? And I can get visa quicker?Even if I got refused , but after appeal I can come back on five year route rather than DLR ten year route?

The thing is I found out I am pregnant last month and my baby will due march next year
and I really want to born baby in Uk with my husband aside.

Could anyone give some advice on where I should apply spouse visa please?

In my own opinion, any case worker will check why you're not applying for ILR at the end of your 5 WP.....So its a matter of you deciding if you're ready to stay outside the country for considerable amount of time to get the Visa or just fighting your case in country.,
IMpossible is 2 letters to long!
