T2 ICT Long Term Cooling off period- Help Please

Dear Gurus

My case is as follows

April 2008-Got 2 years UK Work permit and traveled to UK immediately. Since then I am continuously in UK and received 3 extensions under T2 ICT. I have a valid UK VISA till 1 Nov 2013 ( spent approx 5.5 years in UK)

I came back to India in July 2013. I am now planning to apply again for UK COS/VISA under T2 ICT . PLease guide me if 1 year cooling off period applies to me.

if you were to apply for enty clearance cooling-off would apply.

If you continue working for the same company you can return to the UK while your visa is valid and apply for:either an extension or ILR

I was just searching the forum and saw the below rule

(ii) is applying under the Long Term Staff sub-category and who has, or last had entry clearance or leave to remain as a Tier 2 (Intra-Company Transfer) Migrant in the Short Term staff, Graduate Trainee or Skills Transfer sub-categories, or under the Rules in place before 6 April 2011,

Please suggest why this rule will not applicable to me as I am getting leaves since 2008 i.e. before 06th April 2011

You are correct, my previous post was not clear.

If you apply in the Long Term Staff category the cooling off will not apply.

The rule you quoted is from Immigration Rule 245GB
