Children status after ROR

Post by Chou12 » Tue Aug 13, 2013 9:46 am

Hi,

I have retained my rights after a divorce from Eea national and got 5 years.

I would like now to know which form I should fill to have the same rights applied to my child? FYI the child is not the Eea's child.
Do you know if this straight forward and how long it will take?

Thanks

Was the child born before the divorce was finalised?

The child should be able to retain his right of residence too, if he was born before the divorce. Although it is hard to determine under which provision of regulation 10 he will qualify under.

If child was born in the UK and not travelling outside the UK, then child does not need to do anything. Just register child as a British citizen after you have attained PR.
