Apply from FLR(M) to SET (O)

Post by happygolucky » Tue Aug 13, 2013 1:47 pm

hi,

this is an open question for anyone who can help

my friend is currently hold a FLR(M) as unmarried partner with an English person, visa obtained in Sep 2012. After the couple bought house together, they decided to get married next year.

the question is this
1) if they decided to get married now, can they still use SET(O) for settlement. or they have to re-apply the visa again as married couple. obviously the current visa they have is unmarried partner

2) for life in uk test. does my friend need take the exam before the Settlement and also take it again when apply the uk citizen ship.

thanks

If s(he )was granted flr(m) then s(he) would be applying for settlement on set(m) not set(o).

FLR(M)/SET(M) are the appropriate forms for the Married/Unmarried partner of a settled or Britsh citizen.

No need to switch after marriage.

SET(O) is used for other categories.

There is currently no expiry date for the KOL test, so you don't have to retake it.

Thank you for your reply.

As per the UKBA, here are two KOL for applicants apply next year:

There are 2 ways to demonstrate your knowledge of language and life (KOL) in the UK.
If you are an English speaker (see below) and/or you are currently in the UK as a skilled or highly skilled migrant, you must pass the 'Life in the UK test'.
If you are not an English speaker and you are not a skilled or highly skilled migrant, you must pass a course in English for speakers of other languages (ESOL) which contains citizenship materials.

Question

my friend is Asian and was on Tier 1 Highly skilled visa, then switch to FLR(M). in this situation, which of the above two KOL test is suitable?

thanks

It's the SET(M) applicant's choice.
