Post by leet » Tue Aug 13, 2013 4:37 pm

I am appealing my wife's refusal of visit visa to uk to which I will appeal at a oral hearing in front of immigration judge, does anyone have some good advice or recent dealings in this area that could help me when I go to the tribunal

When did you apply for a family visit visa?

What was the reason for refusal?

it was to do with a couple of areas, firstly her bank statements we supplied 1 years worth of statements, problem they said was that my wife's salary wasn't paid into account, she lives in abu dhabi and her salary is paid via a exchange slip system where her employer supplies this each month with all her details on, ie name, dob, id no, company name and salary to which she exchanges at a bureau each month. My wife had money in the account and last year took out around 1500 pound to which she leant to a family member, this was repaid this feb2013 and they are saying the money is unaccounted for. We explain the reason but they not believe.
Other problem is my wife would after collecting her money would keep it in her home until she saved a substantial amount then deposit it in her bank say every 3 months, so although we have proof of her salary she wasn't putting it into account monthly, this was held against her for some reason.
Since our refusal in may my wife has been putting her salary into her account the same day she takes out at the exchange, so when I see the judge I can say that we have been doing what the eco asked.

Also they state there is no similar history of travel on her passport. My wife has only travelled between abu dhabi and her country of birth Ethiopia.
they say its likely that she would not go back after visit, even though I had letter from employee stating her job would still be available after visit, and her accommodation would still be available, I had a return flight reserved aswell Don't know how to overcome this.

my wife was refused a visit visa 3months prior to me meeting her, she was going to visit a friend in uk but the application was badly written and a lot was missing. We would use this as a guide on applying correctly, obviously not that well though as we got refused.

I have an appeal pending and waiting for my hearing in sept

I am from a loving family and we both have the right intentions of the visit I cannot apply for settlement visa at the moment as my wages do not meet the freshold asked. I go to see my wife when I can but it's hard, so we applied for a 6 month visa

any views??????

Good luck in your appeal your chances of winning are much higher if you get legal representation.

Your wife would need to show very strong ties to her home country to succeed. Why didn't you apply again after the refusal addressing the issues that the Eco raised?

I strongly suggest you get help with your appeal .
