Tier 2 General - ILR

Post by sachin2823 » Tue Aug 13, 2013 11:38 pm

Hello,

I wanted to know as I am on PSW dependent and got it stamped from India.
Now I am in UK and my employer is ready to sponsor me.

My query is If I get Tier 2 general visa, Do I need to go back to India for stamping and Will that count for my ILR or not.

Thanks in Advance !!

1. You cannot apply for leave to remain as a Tier 2 (General) migrant from within the UK.
2. Time spent in UK as a Tier 1 (PSW) migrant does not count when applying for ILR as a Tier 2 migrant.

1. As your current immigration status is PBS Dependant you will need a restricted CoS and then apply for T2G entry clearance from your home country.

2.Your ILR clock will only start ticking when you return to the UK under T2G

Sorry, I missed reading the "dependant" in the opening post. Response edited.

Both of you will need to apply for entry clearance from outside the UK (India).

sorry if i'm mistaken - but has the rules changed with regard to this? as I had a PSW (tier 1) and then switched to Tier 2 General from within the UK.

PSW -> T2G = fine (in country)

PSW Dp -> T2G = new entry clearance

PSW -> T2G Dp = new entry clearance

Basically, they are switching which partner is the dependent. This must be done from outside the UK. Reread.

ferom the T2 sponsor guidance:
