130 days absence in the final year - Eligible for BC?

Post by Haris2108 » Wed Aug 14, 2013 10:04 am

Hi

I got my ILR approved on Feb 27th 2013. I am eligible to apply for citizenship anytime after one year from Feb 27th 2014. However I have following concerns.

1. My total number of days away from UK in the past 5 years is below 450 days i.e around 397 ( most of them are official trips).
2. But in this year, when I went to India for vacation after my ILR, my son was ill and I was needed to stay there for almost 104 days and I was working from India for around 30 days after taking permission from my manager in UK. For another 20 days I took paid leave and another 54 days as unpaid leave.

Now my question is if I plan for another holiday to India , then most probably I will be almost 130 days away from UK in this final year.

And as per the rules one should not stay more than 100 days(90 days or 100 days??) in the final year before applying for citizenship. As I may stay almost 130 days in the final year and if I provide employer letter and medical letter, do you think case worker would approve it? I do not have any home in UK but I have been paying rent even during my absent days all along.

Kindly advise.

Thanks
Haris
