EEA Re-entry

Post by ReubenH » Wed Aug 14, 2013 11:26 am

Hi

Hope that this is in the correct place

My family and I have recently moved here from South Africa. My wife is an EU citizen and I am on an EEA visa.
I have been offered a contract role that would require me to travel to Spain on a weekly basis. I would get a schengen visa for that but my problem is returning to the UK.
How would I get back into the country without my wife with me?
I would apply for the residency card but this would take to long.

I would really like this contract roll but might have to give it up as I am unable to get any information form the border agency people.

Can anyone help on what I should do?

Thanks

if your wife is a uk resident exercising treaty right you won't have any problem coming back. the HO officer will ask you where your wife is, so just tell them she reside in the uk and that your are coming back to her. i very often travel without my EEA husband, and never had problem coming back.

hope this help
GOD BLESS!!!

Thanks

Doesn't it matter that the EEA FP visa in my passport has expired?

Yes, It does. You will require another one to enter the UK unless you have a valid one.

We have moved to the UK and the visa has expired.

Where do I apply for another visa as I would need it to gain entry back into the UK?

where are you now and what your eea national partner doing?

you should apply EEA2 Residence permit as soon as possible once your eea national partner become a qualified person by working/self employment/self sufficiency/studying etc. Even with the RC you will need schengen visa in order to travel spain if travelling alone unless you are a visa free national for spain.
