Child born outside the UK, Only father on ILR

Hello folks,

I got my ILR in FEB 2013, my son was born outside the UK in june 2013, although his mother do not hold an ILR.

Once I get my british citizenship/passport, will my son qualify for citizenship too? What are the options I have in order to get him citizenship too?

Hi Guys,

One of my friend in a same situation, He got British passport and his son born last month and his wife don't have any UK Visa.

Now he want to bring the family to UK, what visa does Kid has to apply.

Note: His son born after he got the British Passport.

The Son would be British by descent assuming the Father was naturalised and the child was born abroad thus, a certificate of entitlement or British Passport. The spouse could look at spouse leave (click).

Hi amber: Son and Wife are on dependent visa, mother does not have a settled status, also when my son was born I was on ILR and no british passport, is there anyway I can apply for a british passport with my current circumstances? many thanks.

No, as the child was born abroad, the child would have to return to the UK, the Home Office would expect the Mother to be settled in the UK too.

Hello Sir,

I hope you are doing good.

My son born outside uk in june 2013 and he got Tier-1 General dependent visa and he is first time came to UK in April 2014.

I am applying for my ILR in May 2014. Can my son eligible for ILR with my application. My wife is not applying for ILR along with my application because she is away 14 months from UK . (my wife has Tier-1 General dependent visa)

Please suggest me, i think you already got answer.

I assume you're applying as a PBS applicant?

As the child was granted PBS dep leave, for the first time, after July 2012, the child will have to wait until your partner becomes eligible for settlement as per 319J(e)(iv).
