Hi

Post by R556 » Wed Aug 14, 2013 4:11 pm

If UKBA treats variation (SETO) of previous application (FLRO) as a fresh application and withdraw the previous application then 3C will be broken? and will it affect over the fresh application I meant when they will look at fresh application will they consider it invalid? As the guidance notes say “a fresh application cannot be made if 3C is running”

Will be grateful if senior members help here

If you had completed your ten years prior to the withdrawal, then you should be okay. However, I do not understand why the caseworker had wanted you to withdraw. Varying an undecided in-time valid application is lawful. Perhaps to save refunding the part of the fees or denying a right of appeal? You may be at a disadvantage, if refused.

Did you use SET(O) prior to, or within 21 days of, the introduction of SET(LR)?
