Visa expired, ILR premium appointment booked for tomorrow.

Hello forum,

I am hoping that someone might have any advice on how to go about the following.

I am a British citizen and my spouse was granted a 2 year visa, 2 years ago which expired on the 04/08/2013. She entered the UK on the 24/08/2011 so technically she could only have applied for ILR in the last week of July.

Because of an oversight from both of us, we only realised now that the visa is actually expired.

We are already booked in for the Premium Service in the morning (15/08/2013) in Cardiff centre.

My question is, what do we need to do now? Should we go to the appointment anyway? What are our options now?

Thanks in advance for any advice given!

Go to the appointment. Has she satisfied the KOL requirements?

Hi Vinny,

Yes, she passed the Life in the UK test. Literally everything else is in order apart from the fact that the visa has expired on the 04/08/2013.
Not sure about what to tell the officer tomorrow though..

Moreover, she should still be subject to the transitional provisions under A280( c )(ii), as it's not a requirement to have extant leave in 287.
