second adult element of WTC while subject to immigration con

My partner claims Wtc and Ctc and both our names are on the tax credits award. There is a second adult element does that mean that I am also claiming as I know I cant??? We also have 2 children who both live with us, please help as applying for ILR very soon . I am very concerned as we never intended to both claim.

That is fine if your partner is not subject to immigration control, I.e. settled or British.

Thank you so much for verifying this for me, my partner was in a tiz about it, we knew we hadn't intentionally claimed anything for me but while compiling the set m forms we noticed the award notice. My partner is British and not subject to any immigration controls. Thanks again good to hear.
