Does Non Custodial sentence affect Tier 1 extensions

Does Non Custodial sentence affect Tier 1 extensions

Hi

I am waiting to receive court summons which could be a non custodial sentence( may be a fine). I am due to apply for ILR next month.
I understand ILR will be refused if you are sentenced by court with in 24 months of your application.

Does it affect Tier 1 Extension as well?

Please share your experiences.

Not unless you declare it.

Do bear in mind that not declaring a criminal conviction, civil judgement and civil penalty has its own consequences.

The form states that CRB check is performed on all applicants (including dependants), so withholding material facts will be construed as false representation.

So are you suggesting that the OP withholds material facts? And implying that lying on the form is a better thing to do? :shock: :roll:

Whether an application will be refused or approved may depend on the severity of the offence and whether the subsequent convictions falls foul under any immigration rule(s).

Oh hell No. I should probably rephrase my answer!

No a criminal conviction will not affect your Tier1 if you declare it.
