Query on ILR (Dependent VISA converted to Tier-1)

Hi,

My wife came to UK on Work Permit Dependent VISA in April, 2008. She had applied for HSMP in India before coming to UK(it was 2 step process at that time - HSMP Letter + Entry Clearance). She moved on to Tier-1 from December'2008 and did entry clearance in December'2008 from India.

As she has completed 5 years in UK around April'2013, is she eligible for ILR now or she needs to wait until December'2013?

Unfortunately, her time as a dependant will not count towards her qualifying period for ILR under Tier 2.

Apologies, I mentioned Tier-2, she moved to Tier-1 from work permit dependant in December'2008.

As it was a two step process at that time, she received her HSMP approval letter around August'2008. But she applied for ViSA in December'2008. Will 90 days rule apply to her? Can she apply based on the HSMP approval date?
