My wife has applied for here LTR in the 28 day window before here current visa runs out. We have received a letter from the home office confirming receipt of the application and giving the application reference number.

Her current visa runs out today and her work has just advised she is no longer able to work. They have a copy of the letter but advise they have to by law confirm it's authenticity with the home office, which will take 5-7 days. This is the first we have heard of this.

Has anybody else come across this. Is there any action we can take for loss of earnings?

She is able to continue working as per her most recent visa whilst an in-time application decision is being made. The employer will be using the Employer checking service (click).

If your wife gave them the letter explaining that she had made an in time application, they should have checked this before her current leave expires.

What is my immigration status while my application is being decided? If you make an application before your authorized stay ends, your existing immigration status will continue until your application is decided, even if the decision is not made until after the end of your permitted stay. You can continue to work until your case is decided if the conditions of your existing leave allows you to do so.

Your leave is "treated as continuing", if you submitted a valid in-time application. However, a problem is that the UKBA may be unable to confirm your right to work.
