Hi there, I am eligible to apply for ILR by end of this month. I was on work permit since 2008 with my first employer and i changed my job with a second employer in 2011 under tier 2.

My issue is I was working with my first employer for 2 weeks after my tier 2 visa had been approved. This is to serve my notice period. This means that my last day working with my first employer is later than the date stated on my biometric card. Someone told me that the 2 weeks I worked for my first employer is illegal working.

The second employer, which is my current employer appointed an immigratin lawyer to apply for my tier 2 visa so that I can change my employment. i wasnt told about illegal working or any restriction that applied following the approval of the new tier 2 visa.Should I proceed with my ILR application by end of this month? Will I or any of my employers face any problem from the home office?

You are eligible to work for current employer until the start date mentioned in the new COS issued by future employer. So you haven't worked illegally. It would have been illegal if you had started with new employer before your application was approved. Dates mentioned in the BRP card will mostly be different from the Start date of CoS. I was in the same situation myself.

One thing to note is that the leave with your first employer should not have expired before your application with second employer was approved.
