Dependant Visa

Dependant Visa

I came to the UK on a student visa and I am still on a student visa. my husband, though, is on Tier 1 General Visa.
I want to extend my visa but as a dependant on my husband’s Tier 1 visa.

Please can I extend my visa as a dependant while in the UK or do I have to travel back to India?
Bearing in mind my visa is due to expire and I cannot travel in pregnancy

advise please

though you already have an EC as a student but I believe you need another Entry Clarance if you are applying as dependant of another person who is on visa or subject to immigration control. unless EU.
thus, you will need to travel back to India
guys am I wrong?

but then again, it is different if you have a baby in the UK. then I cannot explain how the law affects as a result.

please is there any other detailed information or guidance ?

Why can't you travel in pregnancy? Have you crossed week 36? Has your doctor advised you against flying due to a medical reason?

It is not UKBA's problem that you became pregnant and cannot travel due to that fact, or that you became pregnant when your Tier 4 was coming to its end stage and you now choose to change to an immigration category that requires entry clearance.

What you can try - apply for leave to remain as PBS dependant (i.e.- from within the UK) and if you are refused (which you will be) then appeal the decision. Maybe a judge will take a different view and allow the appeal.
