Questions about ILR

Post by saqib389 » Tue Aug 20, 2013 9:32 pm

Hi There

I have few questions about ILR, i am pretty confused as i have not got the exact answer yet.

I will be completing my 5 years on Tier 1 General in June 2014 and will qualify to apply for ILR

My Wife came in UK in 2012 as a Tier 1 General Dependent and when i will be applying for ILR then my wife would have completed 2.5 years in UK as Tier 1 General Dependent.

I have got Son who born in March 2013

So now i have two questions:

Question 1: When i will apply for ILR in June 2014, would my wife be able to apply same time with me as i know there are rules that your dependent have to complete 5 years to get ILR but when my wife came in UK, the rule was the dependent have to complete 2 years in UK in order to get ILR, please advise what my wife should apply as ?

Question 2: What visa should i apply for my Son as my son's visa will be expiring, but i will apply for ILR that time, i understand the rule is if you have an ILR then you british born child can apply for british nationality, please advise how should i tackle this situation because my IRL may not come before my son's visa expires.

Looking forward to hear your thoughts on it
