Urgent Travel to US and CA while processing EEA2

Post by gaon329 » Wed Aug 21, 2013 11:01 am

Hi all,

I've posted a while ago on the boards (http://www.immigrationboards.com/viewto ... 239#762239), and found some very helpful advice, all of which proved very true.

I'm now in the UK, awaiting my RC on an EEA2 permit, which I submitted on 14 July. I am confronted with having to conduct urgent travel to the US on 29 August, with a possible one day trip to Canada during that time, and back to teh UK on 9 September. I requested the return of my docs from the UkBA 20 plus days ago using the online RodRequests form as instructed, called the number at Croydon and they advised me to put in a second request, which I did yesterday. I called today, and the same (very helpful) case worker suggested I use the online form to make an enquiry on progress of my form, as she said it should have been actioned in 10 days: https://eforms.homeoffice.gov.uk/outrea ... quiry.ofml. I have also submitted this, as she said my passport has yet to be despatched. She said these are new instructions they received as of today.

I now have an appointment at the US Embassy to try and get a temporary passport enabling me to make my urgent travel, but she suggested that I contact the British Embassy in the States to see what travel docs I would need to come back in on this passport. This passport will have no visas or anything stamped in it, and my family permit expired in July anyway.

I'm fairly confident that the Embassy will grant me a temporary US passport. But I'm finding conflicting information: do I need to apply for a new family permit in the US to be able to get back in to the UK (and continue to work)? Or may I enter with the temporary passport, letters and COA from the from the Home Office, plus copy of my husband's EU passport, daughter's EU passport (she too is an EU citizen and will travel with me), and other evidence that he is exercising treaty rights?

Sorry for the wordy question - but any help most appreciated!

Obviously, I expect that you will continue to persue UKBA for return of your documents.

You might ask the US authorities if any temporary passport would allow you to leave the US. I don't know, but it may be a document that simply let's you get back to the US.
