Settlement - 28 days and english language query

Hi,

I am planning for settlment in UK and have got two queries. Can someone please help.

1. I have T2 WP, which was stamped on 16 Dec 2008 and I had entered UK on 23 Dec 2008, so 28 days limit would apply from 16 Dec or 23 Dec.

2. As per new rules, there are now requiements for English Lanugage as well. I have got a Bachelor's Degree of Engineering from India and I think i don't need to give the English test; however from where I can confirm this.

If your degree is awarded 10 points on the PBS calculator it'll satisfy the new requirement in addition to the LIUK test or equivalent.

28 days from 16-Dec-2013.

Thanks Amber, I missed your previous response about 16 Dec. Unfortunately I just called UKBA and they say it would be 28 days before 23 Dec, so I am bit confused now :(.

If your current leave expires on/after 23-Dec-13 then UKBA is correct.

If not, when does your current leave expire?

Hi, Since my visa was extended every 2 years, my current leave expires on 31st Dec 2014.

Hi, Also adding, I had first entered to UK on 15 Oct 2008, went back to India on 6 Dec 2008. This was on Business Visa. Then I got my work permit/T2 visa stamped on 16 Dec 2008 and entered UK on 23 Dec 2008 on this WP visa. Does it change any of my 28 days dates please?

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days. This can occur if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed 90 days, it will not be counted as an absence.

From 28 days before 16-Dec-2013.

For cohabitation proof, for roughly every 4 months of the last 2 years, you should supply one joint letter or a letter each from a total of at least 3 different sources.

Thanks; however I could not found that which document i can show for 5 continous year's stay. This is the exact from the SET(O) form.

Hello All,

I had applied for a settlement Spouse visa as my husband is already in Uk from Pune,Maharashtra on 7th August 2013.

Currently i am waiting for my visa,though i am sure on all the documents i have few below queries,Please help me.

1. when can i expect my Visa if i had submitted in Pune VFS office on 7th august and it reached Mumbai on the same day and i got a sms

2. i had completed Bachelor of engineering from India though in my degree it was not specifically written that the medium of teaching was English, i requested my college and my university to provide an covering letter or transcript stating that the medium of teaching was English,which i submitted along with the other degree certificates and gave for visa processing,is this sufficient for English language requirement.

Isn't the date as the UKBA said 28 days before the 23rd of December, as the OPs current leave expires after that date?

I'm confused :shock:
