ILR set (o) returned, what did I do wrong?

Post by questionmark21k » Sat Aug 24, 2013 9:53 am

Hi all,
The documents I sent off for my ILR set (o) I just got back, along with a cheque refunding my application fee.

I am a Croatia national who has got a Work Permit since August 2008.
As I am completing 5 years as a work permit holder I sent off my documents at the beginning of month to UKBA offices.

Yes, Croatia is now part of EU since 1st of July, but I believe after 5 years of being a Work Permit holder I still need to apply for ILR irrespective of my EU status.

The letter that accompanied my returned application states that my application is invalid due to incorrect fees being paid.

If you look at the ILR set (o) form the pages 4 and 5 are payment details section.

It clearly says on top of page 4:
Nationals of Croatia, FYR Macedonia or Turkey must complete this page unless they are applying as a work permit holder, highly
skilled migrant (of either kind), Tier 1 (General) migrant, Tier 1 (Entrepreneur) migrant or Tier 2 migrant. For applications in those
categories, they must complete the payment details on page 5. All other applicants must complete the payment details on this
page only.
Top of page 5
Nationals of Croatia, FYR Macedonia or Turkey must complete this page if they are applying as a work permit holder, highly
skilled migrant (of either kind), Tier 1 (General) migrant, Tier 1 (Entrepreneur) migrant or Tier 2 migrant. For applications in all
other categories, they must complete the payment details on page 4.
I am a Croatia national with a Work Permit, hence I need to fill in page 5, which is what I did, and a price for postal application for a Croatia national is £946 which is what I paid.

However the application was returned stating I have paid an incorrect fee and I should pay £1051

It is not the £105 difference that bothers me, it is the fact that I believe I have filled in the correct part and paid the correct fee as per ILR form and as per the guide document for IRL set (o) form.

Have I missed something, if so what have I done wrong?

It is Saturday now and I cannot call anyone to ask about this until Tuesday (due to Bank Holiday Monday) and my 5 years will expire, so when I eventually send off the application again next week will they tell me I have not sent it in time?

Anyone?

Send it back with a cover note stating clearly that you are a Croatian national applying under the work permit category and thus the fee is £946.

I will call them on Tuesday as well, but am really surprised that they can make a mistake like this.

If its not a mistake then what can be wrong?

When I send it off again, will I get any "trouble" for not applying on time?

Thank you for your responses.
