Spouse visa requirement for British born (Student) Husband.

Hi guys, I was wondering if you could advise me.
I am British born living in London and have a wife and 3 year old kid in Africa.

Question 1
I have been offered a full time BSc study and I will be using student finance.
Can I still invite my wife and child by the rules of the point based system or are British nationals excluded from using this process? UKBA's site is not specific about this.


Question 2
I've been earning £17,780 the last 1 and a half year, and have just been raised to £19,000 within the same company with a new contract.
My university is happy to defer lectures until Feb 2014 but at such time, I'd have to resign my employment.
Do I still have to wait six months should we choose to apply for spouse visa for my wife?

Question 3
Will any student grants or loans count for or against me?

Our son inherits British citizenship from me so we would apply for a passport in Africa. It's my understanding that this subjects us to no more than £18,600 requirement.

You can apply for a spouse visa once you have actually earned £18600 gross in the preceding 12 months prior to your application under cat b. that could be now, I've assumed your earnings are salaried. You are correct that a British child doesn't increase the requirement.

See here (click) also consider the Surinder Singh route, and bare in mind that you'll have to meet the financial requirement again in 2.5 years and 5 years for the UK spouse visa settlement route.
