travel within EEA using ILR

Post by Lyla » Wed Aug 28, 2013 10:13 pm

Dear all,
I am non EEA citizen, I was granted ILR in March 2007 based on marriage to a British citizen, however, the marriage broke down in 2008 and we were divorced in 2011. Now I am living with my partner for five years (unmarried) he is an EU citizen and we have just had a baby. My questions are
1. Whether I am permitted to travel within EU countries using my ILR (stamp in my passport) without visa, based on EEA family member status, without have to apply for a visa?
2. Am I able to apply for permanent resident card as a AAE family member without loosing my ILR stamp, because as far as I am aware that permanent resident card need to be renewed every 10 years.

Thanks :)

Just apply British Citizenship as I can see u r eligible.
and enjoy visa free travel with ur EU partner.
As far as I know, u can not travel visa free with ur unmarried partner.

Going back to my previous questions, Is there any way that I can travel freely without visa within the EU when travel with my

For visa free travel using airlines, you will need a Residence Card of a family member of EEA national following a EEA2 application. Otherwise, the airline will not allow you to board.

The application can take upto 6 months. It will not affect your ILR status and can co-exist with it. You can't apply for a PR as you don't qualify for one (5 years under the EEA rules).
