Immigration History

Entered UK on a Student visa on the 21 Oct 2003.

First absence

was from 01/11/2004 till 28/04/2005 = 178 days went back to my country to complete my courses!

2nd absence

was from 04/10/2007 till 30/10/2007= 26 days, upon arrival Immigration officer stopped me and started questions etc, I was working full time, but I will study too ie full time studies.

Case started with HO, and eventually won the case on the sept 11 2008. and passport was stamped by the IO, because I had valid LTR.

Question here: Will I be considered as a UK resident while I was being on a temporary admission ? UK law says, that if someone is on temporary admission and subsequently grant Leave to remain, that residency is not to be broken.

3rd absence: 02 Oct 2008 till 13 Nov 2008 = 43 days

4th absence: 11 Mar 2010 till 08 April 2010 = 29 days

5th absence: 04 Jan 2011 till 08 Feb 2011 = 36 days

Then I got a job offer in Rep of Ireland with their work permit, I was keep traveling every week to Ireland doing full time job + degree in London back in forth. I completed my degree and earning from Ireland and then changed status from Tier 4 to Tier 1 General. But there are no stamps on my passport showing travel to Rep of Ireland and UK, because UKBA does not stamp your passport when you fly from Dublin to Brittan.

Spent two years in Ireland ie mixed in Ireland and London every week flying back and forth, but I have always the UK resident permit. In 2010 I moved back to UK permanently.

Question here is how do I justify my absence to Rep of Ireland, because I was there 3 or 4 days a week and then 3 days in UK or travel between northern Ireland and southern Ireland every 2nd day.

Subject Access Request copy obtained from UKBA containing my 10 years application timeline. That file includes my court case and my Irish earning details along with my Irish work permit etc.
