Khula in Pakistan

Post by ishmailmalik » Mon Sep 02, 2013 6:24 pm

I got married in Pakistan in March 2013, and was divorced through 'Khula' 3 weeks later. The marriage was not registered in the Union Council and I think the khula has not been registered in the Union Council either.

I remarried 2 months after the khula took place and would like to call my wife to the UK on a spouse visa.

I would like to ask if I need to declare my marriage to the UK Border Agency as they have asked about any previous marriages?

Is there any way the UK Border Agency can find out about the previous marriage and divorce (khula) if it has not been registered with the union council.

Or should I just declare the previous marriage and divorce regardless of it not being registered?

See oversea divorces if you have not followed the prescribed procedure then your divorce will not be recognised thus, nor will your new marriage.
The term 'judicial or other proceedings' requires that there should have been some formal proceedings, either before a court or some other formal body recognised by the state for that purpose (for example, in Pakistan the Union Council). It is an important aspect that the judicial or other body should be impartial as to the outcome of the proceedings.
