TIER 2 visa -- Labor test?

Hey,

I wanted to ask, as Im switching from tier 4 to tier 2, would i have to do the labor test that's required? As i already hold a degree studied in uk am i Exempt??

The company that's sponsoring me i already use to work as an intern. When sending application, better to mention that or not?

How long does the application to get answered? any idea?

If anyone please could clear that for me?
