Tier 1 ILR Short of 30 days

Hi,
i am asking this question on behave of my friend who soon be eligible to apply for ILR of bases of Tier 1(3+2)years.
his hsmp /tier1 granted on 17 Dec 2008 in Pakistan (3 years)
arrived in UK on 21 Jan 2009.
got extension on from 17 Dec 2011 for next 2 year until 17 Dec 2013.
now he has to apply for ILR before 17 Dec 2013 but as you can see he has not complete his 5 years in UK . his 5 year going to complete on 21 Jan 2014.

will he be ok to apply for ILR or he has to apply for another extension???... please your reponse to above matter will be very helpfull for him. kind regards. thanks

The 5 years is calculated starting from the date the Tier 1 visa was granted i.e 17 Dec 2008, as he entered the UK within 90 days of the visa being issued.

Therefore, your friend is eligible to apply for ILR on 17 Dec 2013 (or up to 28 days before this date)
