Question about mother immigrating via son

Post by ktl807 » Tue Sep 03, 2013 11:49 pm

This is a bit of an odd situation, I'll be the first to admit.

I'm an American, and my husband is British. We got married here in the states a bit ago while he was visiting, and he's now gone back to the UK. We always intended to live over in the UK, but unfortunately right now we don't have the means to meet the financial requirements to get me over there, so that's on hold.

Recently, I found out I was pregnant. I know that the baby will have British citizenship due to the fact that my husband is British (not by descent, he was born and raised there). So I guess my question is, can I immigrate on the basis that the baby is a citizen?

I guess I'm just trying to figure out how to make this work (or if I have any options in that way) so that we can be a family since, due to the recent laws, we don't currently match the financial threshold.

Thanks for any help.

Short answer - no - not by itself.

Your child would have to be in the UK - you'd have to have sole responsibility for them OR your husband would have to have responsibility for them, but you wouldn't be able to be married to him.
