ILR - need guidance

Hi,

I have a confusing scenario.

I entered UK in Sep 2008 as my wife’s dependent (Student Dependent) but switched to Tier 2 migrant in March 2009 and have been on that visa ever since. My wife, however, switched from student visa to post study visa in Jan 2010 valid till Feb 2012. She left UK to apply as my dependent (tier 2 dependent) from her home country as required by the rules. She was issued a dependent visa in June 2012 valid until my visa (Feb 2014). All this while we have been staying together as a married couple (have utility bills and bank statements to prove that).

The gist of the situation is given below:

My Details
Enter UK (Date) Visa Valid from

Sep 2008 Student dependent Sep 2008
Switched Tier 2 Migrant (General) Mar 2009
(Valid till Feb. 2014)
Complete 5 years in Feb. 2014



My Wife’s Details
Entered UK (date) Visa Valid From

Sep 2008 Student Sep 2008
(Valid till Jan 2010)
Switched Post Study (Tier 1) Jan 2010
from within the UK (Valid till feb 2012)
Switched Dependent June 2012
from home country (Tier 2 migrant) (valid till Feb 2014)





I complete my 5 years (pre-requisite for ILR) in Feb 2014. My wife also completes 5 years but on different visas.
My query is: can my wife apply for ILR along with me in Feb 2014?
