Dependent - 2 Year calculation

Post by adnan742 » Wed Sep 04, 2013 7:09 pm

Hello, can someone please advice?
I am applying for ILR next month on Tier 1 (Gen) route and have completed 5 years, my wife came in UK on 10th December'2011 but her visa stamped on 12th November'2011 ( she enter the county within 90days), my question is how they calculated 2 years for dependent? either they take visa stamp date or UK entry date? can someone please let me know and give any reference from the UKBA guidance notes?

Thanks

In my case they considered my wife visa stamp date. My wife entry was delayed by at least 65 days.

But I know several members on the forum that their application have been put on hold until they have completed the two years i.e. from the date of entry into the UK.

And I used Solihull to apply while others were applying at Croydon.

10th December 2013 is when your spouse would qualify, subject to meeting the other requirements.
