FLR(m)application on hold

HI,
I have a friend who has applied for FLR(m) visa through post with 4 months paylsip of his wife ,he could not submit 6 months payslip as they got married 4 monnths back. He was in student visa but his college get closed and he did not want to apply for another student visa rather he applied for FLR(m) with 4 months payslip of his wife.
Now he has received a letter from home office saying that his application is on hold casue he has not provided 6 months payslip and home office has informed that a pakistani guy has challenged in court about providing 6 months payslip and the guy is asking if 3 months paylslip would be sifficient. Home office has asked my friend that they are waiting for the result of this case ,so he might wait or he can withdraw his file.
Now my friend has sent another 2 months payslip which are dated after the application was sent. Now he is really worried about the outcome of his application.
will he be overstayer if he withdraws his application ?( although his student visa is valid until 2014 ,though he is not admitted to any college for last 4-5 months).
He wants to know can he ask homeoffice to send him back all his payslip and passport without withdrawing the application and then apply to a PEO directly ?
Please Gurus let me know your thoughts ,i am writing on behalf of my friend as he is devasted and his english is not so well.

Why could he not submit the require number of wage slips. What was his status before his FLR(M) application and when was the application made?

The application was made in July 2013 ,before then he was in student visa ,he could not submit required payslips as his wife started job only 4 months back so he only 4 months payslip available at the time of application

Well as soon as you have the 6 months wage slips required, send this evidence in and ask for a reconsideration of the case.
