Have a question regarding overstayer

Post by mememe8658 » Thu Sep 05, 2013 5:43 pm

I have just got my ILR via 10 years route, however my bf is an over stayer since 2008. We have been together for 2 years and I really wish to help him with his immigration status. However eventually I cannot marry him because my parents wouldn't like him at all... Don't know how to explain this, he is very nice to me and I wish to at least help him with something before I leave him.

I am holding Chinese passport, as an over stayer does he need to return to China for spouse visa? If he get the visa issued, will I not be able to marry at all for 5+years?How about if I get british passport ?

Anyway, I hope someone can let me know the chances of giving him legal status in the UK.

A sham marriage is not the answer to his problems.

If you were to legitimately marry and apply for a 'spouse visa' outside the UK, you'd need to meet the financial requirement (earning £18600 pa and/or significant savings) amongst the other requirements. I assume you will not naturalise as you'll lose your Chinese citizenship.
