ILR Eligibility question

Hello All,

Request you to please take a look at one of my below queries and reply.

I'm currently employed by a UK limited company under Tier 2 ICT since Oct 2008. I would be eligible for my ILR this Sep. However, I have a query with regards to my continous period qualification. My absences in UK are as follows:

Year 1, 2, 4 and 5 - Lesser than 35 days.
Year 3 - 30 days of paid Leave and 75 days of unpaid leave (a total leave of 105 days).


I have been employed under one company all through these five years. During the year 3, I was on my annual paid leave to India (for 30 days), but due to a medical condition I was advised complete bed rest for 2.5 months (which was a loss of pay).

I would be supplying a letter of employment which says that I was yet a UK based employee during the absence in my 3rd year. I would be supplying all the medical documents related to the above longer absence as well.

Going through the UKBA qualifying period document and other queries in immigrationboard, the application seems to be straightforward. But, just wanted to be sure of this before applying.

So long as your absences are <180 days per 12 month period you'll not be required to submit evidence.
