Tier2 ICT Short term to Tier2 General

Hi,

I've arrived UK on COS- ST (Tier 2, ICT shortterm) on oct 2012 and left UK on jun 2013.
Currently, i'm working in Europe on same employer from India.
I would to like to swith tier2 general, my new employer/sponser will to pay me > £ 41k.
In this case, do i need server 12months cooling period or i can start with Tier 2 General processing with my new sponsor??

12 months is for anyone earning less than 150K.
