Change of last name; EEA family permit

Hi,

My wife applied for a 5 year EEA family permit visa which she received in 2010. Before coming to UK (from India), she did not change her last name after marriage in her passport. She recently decided to change her last name (to mine) in the passport and received a new one.

So the question hereby is :
Does she need to transfer the 5 year visa on her new passport or can she keep her old passport (with the EEA visa) together with the new passport for travelling abroad? So, if we keep the old passport, do we have to inform Home Office ?

Sorry to be a little pernickety, but I suspect your wife has a residence card and not EEA family permit.

There is no obligation to apply for a new residence card with the name change. She can if she wishes apply for a new card. If she does this, UKBA will treat this as a fresh application.

I doubt you would have any problems at a UK border, but would not guarantee that you would never have any issues at check-in. You would need to have your story straight and evidence to back it up.

Sorry it is indeed a residence 'card'. What more evidence than a marriage certificate+old and new passport?

I would have throughout it obvious what the situation would be from the old to new passport. Presumably all the other details would be the same apart from the family name.

Marriage certificate would also help.

Airlines might be a problem, be careful who you fly with.
