Hi all,

My wife came to UK in 2003 as a student and then after 1 year she came to Pakistan and we got married and I came to country as student dependent . we were on student visa for 3 years and before the visa ran out we applied asylum , The application was refused and we dint have any right to stay for 1 year in UK . My solicitor applied for settlement on human rights ground at that time my first child was 6 years old , this application was refused again . My solicitor again sent an application and now my first child is 7 years old , biometrics were done 6 months ago and not have had decision on this application . I have 3 children all born in the country 4,2,7 years old .
My 7 years old child has been out of country for only 2 weeks in 7 years.

Please advise whether there are any chances of my application being accepted now as one of my child is 7 years of age . I have spent loads of money on solicitors fees and application fees . Do I need to inform home office now that one of my child is now reached 7 years age while application is in process .
I applied for permission to work but that has been refused as well .
I have contacted my M.P in this regard but no help from there .

Pleae advise

Yes given the child's best interest as in the UK 7 years, see exception 1 guidance (click).

thanks guru will this be discretionary leave or can apply for settlement . I heard rules have been changed and it depends on case workers discretion how many years they give , before a person could apply for settlement straight away.

Family life leave is now 2.5 years at a time with a route to settlement of 10 years.

@akhan did you put in international passports in your application?
