British Citizenship for someone born in ZAF with GBR father

Post by ukpass123 » Tue Sep 10, 2013 11:09 am

Hi!
I'am back. This time on a different side of the forum :).
My partner is from South Africa, he was born there. He's got a family visa based on my EU rights.Mean time , I got my British ppt.Everything is ok with us but we were thinking of doing something for his brother or his mom who are still in South Africa.

His mom's case:

She was born in South Africa ,exactly 60 years ago.Her first language is English - not Afrikaan, although she speaks both. Her mom(my partner's grandma) was South African but her father(my partner's grandpa) was Welsh (British). Her father(my partner's grandpa) died in a car accident when she was 3 year old so looon time ago.Based on this:Is she entitled to British Citizenship?
She's got her birth certificate (which mentions his name) and nothing else.

If it is possible, can her child (my partner's brother who is 27 now) get directly at least the right to work in the UK, as the country of his grandpa?

Many, many thanks for your help.

Was the Grandfather British otherwise than by descent (i.e. born in Wales or naturalised) and were the grandparents married?

He was British - with British Passport - not oversees...British and yes, they were married.
So, would it be possible?
Thanks in advance for every little piece of help.

Then the Mother could be British by descent and eligible for a British Passport.

Her child (aged 27) could be eligible for a UK ancestry visa (click)

OMG !I can't believe.I was fighting for my partner's right in the UK so much....Indeed knowledge is Power. However, I know that there is a rule, I can't find it now ...which says that if someone was born before 1962( I guess) that person is not entitled to a British Passport/Citizenship, although the father was British.

Am I right?

Many , many thanks for your help.

I think you are referring to some CUKCs and that once such countries gained independence in 1962 they would lose their citizenship of the UK & Colonies status. You should seek professional advice for further information.

South Africa became an independent state on 31/05/1961 - My partner's mom was almost 8 and her dad was already dead....

I don't know what to believe...

Maybe there are some other members on this forum who know more so that they could share the information with us.

Many thanks,
