PSW to Tier 2 (CoS details enquiry)

Post by Angelic » Tue Sep 10, 2013 11:23 am

Hello All,

I am currently on a PSW working for a UK registered employer, they have assigned me a CoS and a pay rate that is appropriate to the occupation but on the CoS it says that the job offer / pay raise starts from the day my current leave finishes. would i still come under PSW applicant? or is that going to be an issue.

I am just worried if the CoS (Job date on the certificate) should start before my Visa finishes.

Visa finishes 06 Dec 2013

Thanks.

there is no such thing stated on a coS.

You must receive the salary appropriate to your SOC code from the work start date given in the CoS. What is this date?

Thankyou for the response Manci,

It was my mistake javascript:emoticon(''), i explained the situation very poorly. The start date is 06 Dec 2013. This also happens to be the expiry on my Visa. Should the start date be before or within the current Visa?.

Further details

Job code is 3421
Salary is 21,000/-
start date is 06 Dec 2013

been with the same company for a year now.

What docs must i submit with my Form? currently planning to submit these:

Masters Degree and Transcript
Bank statement (90 Days)
Passport
BRP
Pay Slips (6 months)
Photos (2)

Currently waiting for the Bank Statement.

Problem:
even if your job under SOC code 3421 is on the shortage occupation list it is an NQF level 3 job and the minimum requirement is NQF 4.

http://www.ukba.homeoffice.gov.uk/polic ... appendixa/

I have not yet used my CoS, can i ask my employer to change the details on the CoS?

I could ask my employer to change the code to Artists 3411 and i'd qualify for new entrant. what else would the employer need to change on the CoS, do they need to change the duration for the visa? currently it is 06 Dec 2013 to 05 Dec 2016.

Thanks a lot in advance Manci, you're a life saver.

since you are switching from PSW you will be a new entrant in any case , that is not the issue, the problem is the NQF level.

SOC code 3411 would be acceptable with a min salary of £20,300 for a 39 hour week but your employer would need to assign a new CoS - hopefully they have an allocation available, if not they will have to apply for one. The cost to the sponsor for assigning a CoS is £184.

Remember also that the choice of SOC code is not yours, it is the sponsor's, they are taking responsibility for it. The 3 year period for the CoS is OK.
