Co-habitation evidence query

Hi All

I have a query regarding co-habitation evidence and hope somebody here can clarify the situation for me. My circumstances are as follows:

I got my work permit in Oct 2008 for 2 yrs and 4 mnths. My wife joined me as a dependant in Feb 2009 and has been staying with me since then. In Jan 2011 I changed employer and became a TIER 2(General) migrant and my wife became a PBS dependant. We will qualify for ILR this Oct and are hoping to apply in the 1st week of Oct. Looking at SET(O), it says provide evidence of cohabitation since you were last granted leave (up to a max of 2 years).

Now my question is do I need to provide evidence covering the last 2years immediately preceding our application (ie Oct 2011 -Oct 2013) or can it be any 2 years within the 5 year qualifying period (ie Oct 2008 - Oct 2013)? I read elsewhere on this forum that it need not be the 2 years immediately preceding the application, but is this true? Does it have to be since we were last granted leave or is it since my wife's first entry clearance (Feb 2009)? Can someone please clarify?

As "rajesh9pl" said two years from the date of ILR not from July 2012.

Sorry, just to correct you, its from last grant of leave ( upto two years) . So it will be from july, 2012 for me.
Just read it in section 11A of the SET(O) form.

SO that means answer to Q19 in the FAQ section needs to be amended.

I am not sure if I can provide sufficient evidences in my wife's name for the last 2 years. She doesn't have many utitlity bills in her name, most are in my name and she isn't working either. I have the following:

Council Tax statement - Joint names - March 2011 - Feb 2012
Council Tax statement - Joint names - March 2012 - Feb 2013
Council Tax statement - Joint names - March 2013 - Feb 2014

Bank statements (her name) – June 2011 - Dec 2011

Driving lessons bills (2 bills in her name) - July 2011 and Sept 2011

Tenancy agreement (joint names) - Feb 2011 – Feb 2012
Tenancy agreement (joint names) - Feb 2012 – Feb 2013
Tenancy agreement (joint names) - Feb 2013 – Nov 2013

Child Minding Contract (Joint Signatures) – April 2012
Sky TV bills (her name) - Feb 2013 - present

Can someone let me know if this is enough to cover the period? I can produce sufficient evidences in my name during the same period, but its her's that I am worried about. Please help.

Sudarsanam,

Take a letter from your local GP
Take a letter from the city council
If you both registered for the voting, take a letter from Electoral
Provide Provisional driving license both parts
Any letters from NHS in your wife name

Many thanks for your tips. We have been living at a new address for the last 7 mnths (since Feb 2013). So if I were to follow your advice, I should then be contacting our previous local GP to certify that my wife was staying at the old address, is that right? And I guess the same applies with the local council although I have council tax statements for all the periods?

Her license has the new address, trouble is proving her time spent at the old address (Oct 2011 - Feb 2013). Would a letter from our previous landlord be useful besides the old tenancy agreements?

Yes, take the GP letter and city council letter from your previous address.... My advice is..take all the documents you can get reference to your current and previous address.... Best of Luck!
