Am I eligible for ILR with diff Tier 2 ICT

Dear all,

First date of entry in uk is: 02/04/2009


All visas are done in India.I have travelled to India everytime my visa near to finish and re-applied before it get finished.I haven't stayed more than a month on each occasion.

I would like to know whether i am eligible for ILR or not.


Here are my visa details:

First Visa: Tier 2 (INT COM TRAN) MIGRANT
Duration:23/03/2009 to 23/04/2010

Second Visa: Tier 2 (INT COM TRAN) MIGRANT
Duration:23/04/2010 to 23/05/2011

Third Visa: Tier 2 ICT SHORTERM STAFF MIGRANT
Duration:24/05/2011 to 23/05/2012

Fourth and Visa: Tier 2 ICT LONGTERM STAFF MIGRANT
Duration:12/06/2012 to 11/07/2015

what were the dates of your absences from the UK?
what was the purpose of the absences, e.g. holiday, work, compassionate, etc.

I was on holiday on these following dates

09-Apr-2010 to 03-May-2010:25 days
03-Sep-2010 to 27-Sep-2010:24 days
28-Jan-2011 to 06-Feb-2011:10 days
29-Apr-2011 to 05-Jun-2011:38 days
18-May-2012 to 17-Jun-2012:30 days

Total: 127 days

Reasons: Visiting family, marriage

the relevant rule is on p27 of the ILR guidance:

The continuous period is maintained if the:

 applicant leaves the UK without valid leave, but re-enters with new entry clearance within 28 days of their leave expiry date, or
 applicant leaves the UK with valid leave and re-enters the UK whilst that leave remains valid, provided the absence(s) do not exceed 180 days in a relevant 12 month period.

If the applicant’s leave expires whilst they are outside the UK and they apply for new entry clearance more than 28 days after their previous leave expires, then the continuous period is broken and leave is not aggregated.

According to the above your holidays did not break continuity of residence and you will be eligible for ILR
