Hi, thanks for reading.

My wife is soon to apply for ILR..I claim working tax credits as I am a British Citizen..my question : Is WTC classed as part of my income for the purposes of her application, when UKBA consider if I am able to take care of her financially..(I have been self employed for over twenty years)..She got her spousal visa back in 2011 so before the new rules.

Yes tax credits and child benefit (if applicable) can be included as income under Part 8 (the old rules). Tax credits should be in joint names as you're a couple.

I really do appreciate your prompt reply !! Yes they are in our joint names. If you don`t mind me asking one more question... : Is it the case then that the only thing changed under the old rules is the need to gain an esol 3 after 28th October this year.?

From the 28-Oct-2013 an applicant for settlement or naturalisation must satisfy KoLL plus a B1 English language requirement. When in 2011 did your spouse enter the UK?

Oh ok..she entered in November 2011..sorry what is Koll?

I thought she had until 28th October (edit..to apply) to pass just the LIUK test.? She takes the test on 19th September..next week..:) Her visa expires 5th January 2014

edit we were going to try and apply very soon after..presuming she passes !

Based on the dates you've stated she can't apply for settlement till 31 October 2013. The life in UK test will be needed in addition to the B1 requirement, depending on which Country she is native, does she have a degree which was taught in English?

Is that 28 day rule set in stone.?

She is Filipina and has a BSc in Commerce taught in English

If she has a degree taught in English then she should get a NARIC statement of comparability (click) and a letter from the institution to say it was taught in English along with the degree certificate. This should suffice the new requirement in addition to her pass of the Life in the UK test.

Amber, thankyou for your time and all your help !!..I believe this has cleared things up for us considerably and at least now, we know what actions we can take.


Amber I forgot to say..when my wife originally applied for her spousal visa the degree wasn`t accepted for esol 1, unless we were mistaken..?maybe the language part is sufficient but not the whole degree..??
