Has anyone had a decision on Paper Hearing ?

Post by lily2013 » Mon Sep 16, 2013 11:44 am

Hi Everyone,

I applied for a paper hearing since July and has since received a letter from the court about sending in supporting documentation by 3rd Sept 2013- which I have sent. My question now is when do I expect a decision? With the oral one its a bit straightforward in that you get a decision sometimes on the spot during hearing or within a 10 working days or so from that date. Paper one , i feel like a sitting duck!

Refusal grounds : HO says I didn't include current appointment report , ( But I did).

2. Contract did not specify in details services rendered - In thier words "Its vague" - Hence they are not satisfied that business is active

Supporting documents sent - Bank statements, unaudited report, CAR, and a new contract.

Paper hearing appeallants - do share your experience here! Thanks

well before everything that you have asked about I strongly recon you to have your paper based appeal changed for oral one because having everything provided and in place there are further aspects within a case that can only be dealt through oral conversation or arguments.. do not ever go for paper based appeal..

you talked as they said about current appointment report to have had not been provided you I think provided a print out as accessible through signing in to your account wanted you to provide one posted to you for a fee by Company House this objection I have seen has been set aside many times by a court.
you continue asking services to be not in detail mentioned on the contract you provided if you think or know you at least mentioned the services you should be okay with that as you would have provided services as you claim and invoices against this provision and shown the incoming into your business account.. having above in place a business activity can not considered doubted

a word of advice ... go for oral hearing ...

Many thanks Top for your comments. I am using a solicitor who has advised that I opt for a paper hearing since the refusal reasons are pretty straight forward and can be argued on paper.

I am sure there are people out there who have succesfully appealed on paper. My question here is more related to a guide to the processing time/turnaround time after the being given a deadline date for submission of supporting documents which was 3rd Sept in my case. Please anyone who has or know someone that has appealed on paper, share their experience. Thanks again for your reply
