I'm desperately waiting for over 15 months combined. If the UKBA refused me again, would I still have to pay this charge for a fresh application?
EEA2 sent : 5-12-2012
COA w/right to work received : 2-01-2013
Refused w/right of appeal : 01-10-13
Parliamentary ombudsman got involved, asked for a review : Nov'13
RC received Dec'13

Appeal and if sucessful claim the appeal fee back

I would appeal, and as part of the appeal cover letter ask for the fee to be refunded.

It is not obvious that a right of appeal has not been conferred this time, however it is unclear why it was not granted the last time.

Perhaps it was granted on this occassion.



It is strongly advised that it is pursued. Simply replying will just prolong your agony.

The first application was refused because the UKBA wasn't satisfied with the identification documents I provided such as my national ID card in English(my embassy were having technical issues with printing passports and mine was delayed for long). They just found a decent excuse and refused without a right of appeal even though they could've accepted my ID which was recently issued by my embassy and even had my UK address on it.

I got my passport two weeks after refusal and applied again. Now it's coming to 10months and I'm still waiting for a decision. I've been told so many different things that I'm baffled.

About two weeks ago got an email from UKBA saying a decision has been MADE

2days later that a decision is being FINALIZED

Last week from my MP that a decision WILL BE made in 10 working days.

Today from my solicitor that upon her enquiry with UKBA, she learned that there's no updates and the file is waiting to get assigned to a caseworker.

Why is everyone lying to me ? Would they lie to the MP too?

Solicitor has advised me to go for a judicial review. What shall I do? :'( :'( :'(
