Hello all

Pls I need ur advice

I just applied for flr(o) on the bAsis of parent of child in the uk.my baby is just two months old.me and the father are not together at all but he's interested in claiming the benefits for the sake of the child
My questions?

Is getting a council house same as housing benefit?
Can I claim a council house while on Dlr or the father who is British can apply for me to get the council house?
Can he claim the child benefit in his name and put my account details as the beneficiary?

Pls I'm just clarifying cos I don't want anything to disturb my outstanding application?

NB. was on psw before I applied in august 2013

The new family life leave has a no-recourse to public funds attachment, generally.

If you're living with your Mother who has ILR, she should be claiming child benefit and tax credits for the child. Moreover, she should be claiming housing benefit with you as an adult non-dependant for which there may be a small deduction in benefit. This is the reason I am shocked and annoyed that the new article 8 leave doesn't allow access to public funds. Although, you can work on such leave. Housing assistance may be deemed as a public funds, but it depends on the type of referral.

Please could you pls advise what benefits he can claim for me in his name and I can receive so it won't affect me directly as he is willing to get all these for me for the sake of the baby.can I get a council house as I do not have one at the moment? And can he apply for the benefits and use my account as the receiving account?

What Country are you native to?

He can claim child benefit and tax credits but that latter may be affected by his income. He can claim if he is responsible for the child, which he may be. The money can be paid into your account.

If he's not living in the home he won't be able to claim HB however, he may be good enough to help you with the rent?

As you are a parent you can be granted a non-secure tenancy, or licence of housing accommodation by a local housing authority in England even though you are subject to immigration control.

Guardian's allowance is for children whose both parents have died!

If the UKBA do not allow you access to public funds once your leave is granted, you need to write to them and explain that in the interest of the child's welfare you should be allowed access to public funds.

Until then can't you just stay with your Mother? Your mother should be claiming child benefit and tax credits.

hello
i cant stay with my mother for a long time.shes housed me since i gave birth. im just looking to get a cheaper rent through housing if its available for someon elike me subject to immigration control though i have a british child.I am not looking for a free council house.
i called a housing assoctaion today and they are referringh me to tthe council which i know its the wrong route for me
