Indefinite Leave to Remain revoked???

Post by startrax25 » Tue Sep 17, 2013 8:00 am

Hello
My partner gained ILR in 2010 after being in the UK on an Ancestry Visa since 2004. Not long after he got the ILR we both left the UK and have not been back since. I just wondered what happens if he has been living out of the country is the ILR still valid or if we were to go back to live there at some point would he have to go through the process again.
Thanks

ILR holders are subject to the returning residents provisions. Staying outside the UK for longer than two years will probably mean that he will have to go through the process of UK Ancestry again.

Thanks, I will look up that info, I am not sure how that works if you just want to go for a couple of weeks holiday as well.
I guess its best to stay in the same category ie ancestry rather than switch to a partner visa as I am a british Citizen
